Licenses

KeyGene has many proprietary technologies and gene patents. Licenses are available on a case by case basis.

For the AFLP® technology the general license strategy of KeyGene is described:

AFLP® is a proprietary technology of KeyGene that we use in our contract research applications as well as in service work for third parties all over the world. The AFLP® technology was patented worldwide by KeyGene in 1991 and at this moment patent protection has been issued in many countries under which Canada, Europe, Japan, Australia and USA.

Research applications only
For research applications only AFLP® research kits are available from our marketing partners InvitroGen, Applied Biosystems and LI-COR. InvitroGen markets AFLP® kits for radioactive or chemiluminescent detection. LI-COR markets kits for detection on their Automated DNA Analysis Systems.
AFLP-kits are available for producing AFLP® fingerprints of plants, microorganisms, yeast and fungi all based on EcoRI and MseI digestion.
LI-COR is also marketing an AFLP® kit for gene expression analysis experiments. This kit is based on TaqI and MseI digestion.

The research license excludes all research performed by companies or (in part) supported or financed by companies

Commercial applications
Because of the fact that KeyGene provides AFLP® services KeyGene does only in exceptional cases grant licenses for AFLP® service work on a commercial basis.
To be able to benefit from the virtues of the AFLP® technology, KeyGene provides services and/or limited licenses to interested users. The conditions are outlined below.

Services
The service laboratories of KeyGene can provide a customer with state-of-the-art services on AFLP® applications. By utilizing this service a customer will benefit from KeyGene’s expertise (more than 15 years of experience in genetic analyses), from the latest improvement in AFLP® fingerprinting and KeyGene’s proprietary AFLP® Image Analysis Software.
AFLP® data and the conclusions, which are obtained through this service, are owned by the contractor and may be used for in-house applications without the need of a separate license.

Limited project license
For commercial applications, a commercial use license is required. Such a license is available only on a limited basis and not for commercial service activities.
However, to facilitate AFLP® experiments in research institutes like Universities KeyGene provides project based AFLP® research licenses. These licenses are granted for individual predetermined projects, valid for a limited time period and with a maximum volume of AFLP® reactions per year. KeyGene reviews project proposals for this purpose and upon approval, provides researchers with a standard license agreement in which the conditions are outlined.

Target: Universities/Institutes; projects executed for and/or with commercial parties or partly paid by commercial parties.

Standard Limited License that includes:

  • AFLP® license for the period of a specific project
  • Maximum volume of AFLP® fingerprints/reactions per year
  • Use of AFLP® kits when possible/available
  • Handling fee per year (standard costs = 3,000 Euro)
  • Option for KeyGene to obtain a transferable license to improvements and/or AFLP® based technologies generated in the project (under terms to be negotiated with favorite nation clause/under favorable conditions).
